State-law claims that Michelin Tire Corporation committed fraud and negligence by falsely informing Prudential Insurance Company of America that a benefits plan participant failed to disclose certain medical conditions, ultimately leading to the termination of his long-term disability benefits, is preempted by ERISA, the U.S. District Court for the District of South Carolina held. All the plaintiff’s claims rest on Michelin’s performance of its duties under its employee benefits plan, the court said.
