Case: Health Care & Benefits/Long-Term Disability Benefits (E.D. Ky.)

A federal district court in Kentucky granted Hartford Life and Accident Insurance Co.’s motion for judgment in this ERISA action brought by a Countrywide Financial Corporation manager challenging the denial of her long-term disability benefits. The manager challenged the denial of her benefits for degenerative disc disease, fibromyalgia, migraines, sleep apnea, hypothyroidism, neck and back pain, limited mobility, insomnia, and fatigue. The court found that Hartford’s decision to terminate the manager’s benefits was not arbitrary and capricious, because the medical and non-medical evidence in the record provided substantial support for the administrator’s determination, and the administrator’s handling of the evidence...
