United Behavioral Health’s motion for summary judgment was granted by a federal district court in Utah in this ERISA action by an employee challenging the denial of benefits for his minor daughter. The minor entered residential treatment for her ADHD, depression, anxiety, post-traumatic stress disorder, reactive attachment disorder, oppositional defiant disorder, and Asperger’s syndrome, and United denied coverage. According to the court, United’s determination that the minor didn’t meet the plan criteria for residential treatment was not arbitrary or capricious.
