State-law claims of promissory estoppel and breach of contract stemming from Alorica, Inc.'s alleged failure to pay benefits under a severance pay plan are preempted by ERISA, the U.S. District Court for the Eastern District of Michigan held. It further dismissed Thomas Robinson’s separate ERISA count without prejudice for failure to exhaust administrative remedies.
