Atrium Health Hit With Would-Be Class Action Over Benefit Plans (1)

Atrium Health underfunds its pension plan and evades its obligations under federal benefits law by wrongly claiming to be a “governmental entity,” a new lawsuit alleges.

Atrium, a North Carolina hospital system with more than 65,000 employees, incorrectly relies on a legal exemption for governmental entities to avoid giving workers protections afforded by the Employee Retirement Income Security Act, the lawsuit claims. Atrium’s pension plan is underfunded by about $379 million and workers are forced to wait too long to vest in their pension benefits, according to the Nov. 19 complaint.
