Arkansas Drug-Pricing Law Struck Down by Judge

An Arkansas law forcing companies like Express Scripts and CVS Health to disclose how they price generic drugs is preempted by federal benefits law, a federal judge ruled (Pharm. Care. Mgmt. Assoc. v. Rutledge, E.D. Ark., No. 4:15-cv-00510-BSM, 3/1/17).

The 2014 law is one of several recently enacted state laws aimed at supporting pharmacies in the face of declining reimbursements from pharmacy benefit managers by forcing PBMs to make drug-pricing disclosures and keep their drug reimbursement rates above certain levels.
