Arizona Must Turn Over Transgender Surgery Data (Correct)

Arizona must give a transgender professor at the University of Arizona documents discussing why it excluded medically necessary gender-affirming surgery from its employee health plan because his need for the material for his class action outweighs the state’s interests, a federal court said.

The deliberative process privilege doesn’t protect the documents from disclosure to Russell Toomey during discovery in his lawsuit alleging the exclusion is discriminatory and unlawful, the U.S. District Court for the District of Arizona said.
