Forensic Imaging Allowed to Prove Trade Secrets Case

An employer is allowed to make forensic images of a former employee’s computers to prove he breached the confidentiality agreement in his employment contract, and misused trade secrets, a federal district court said May 1.

List Industries Inc., which accuses Dean Umina of taking a hard drive with him when he stopped working for the company, may use forensic imaging to detect pertinent activity on it and the devices he used to access it, the opinion by Judge Sharon L. Ovington of the Southern District of Ohio said.
