Ford Unable to Offer Seat Belt Non-Use Evidence in Georgia Case

Ford Motor Co. may not present evidence that a couple who alleged a truck’s air bag restraint system was defective weren’t wearing seat belts, Georgia’s top court said, applying a state law that bars evidence of seat belt non-use from being offered to mitigate liability.

Kristen Domingue and her husband were in their 2015 Ford SRW Super Duty Pickup truck when it was struck by another vehicle, according to the court. The front passenger airbag allegedly failed to deploy, and Domingue hit her head on the windshield. She allegedly sustained serious spine, neck, and head injuries.
