Convergys, Ex-Worker Headed for Trial on FMLA Interference Claim

A jury must decide whether Convergys Corp. violated federal medical leave law when it fired a part-time employee who missed work while hospitalized for a kidney stone, the U.S. District Court for the District of Utah ruled.

Hope Zisumbo’s evidence supporting her claim that Convergys interfered with her rights under the Family and Medical Lave Act includes a text message from her supervisor, which stated “we term you for medical reasons,” the court said Tuesday. But she ignored “important evidence to the contrary” in arguing she was entitled to judgment without a trial, the court said.
