Boeing’s Sanction Challenge Rejected in Stratotanker Trial

An Alabama federal court sanctioned Boeing Co. for evidence destruction with an adverse inference instruction to the jury in a contract breach trial involving the KC-135 Stratotanker aircraft.

Boeing failed to show that the sanction—telling the jury to presume that lost information was unfavorable to Boeing—would be improper, according to the one-page order issued Friday by Judge R. David Proctor of the U.S. District Court for the Northern District of Alabama.

The instructions were issued Thursday.
