3M Forces Government Doctor to Testify in Earplug Bellwether

A doctor who managed a hearing-protection program at Fort Benning must face a deposition in a combat earplug litigation test case against 3M Co., because the U.S. government lacks adequate reasons for withholding him, a federal court in Florida ruled.

3M and its subsidiary Aearo Technologies LLC want Dr. James Davis to testify about the Hearing Conservation Program at the Army base and how it was implemented, including the selection, fitting, and instructions for devices such as the Aearo Combat Arms version 2 earplugs at issue in the suits.
