3M Earplug Court Trims Expert Testimony for Upcoming Test Trials

Both 3M Co. and military service members who allege the company’s combat earplugs failed to protect them from hearing loss scored some wins in attacking each other’s proposed expert testimony in several bellwether cases, according to a decision of the federal court overseeing the litigation.

Doctors testifying for 3M can’t use a measurement scale used in workers compensation cases to rate the litigants’ hearing impairment, and some proposed testimony that the plaintiffs hear well in noisy environments isn’t supported, Judge M. Casey Rodgers said Sunday for the U.S. District Court for the Northern District of Florida.
