EU Tax Data Demand on Unnamed Investors Is Lawful: Court Adviser

Europe’s top court should allow member states to request information about groups of unidentified shareholders and beneficial owners during tax investigations, an advocate general said Thursday.

Such requests comply with the European information-sharing Directive No. 2011/16, as long as they: provide the most specific and detailed description possible of the group; explain the group’s tax obligations and the facts on which the request is based; and show why the authorities have reason to believe the group has violated the law, Advocate General Juliane Kokott said in an opinion.
