San Francisco to File Pre-Emptive Lawsuit over Tax Initiatives

San Francisco is filing a pre-emptive lawsuit to head off any challenges to two voter-approved initiatives raising taxes.

California Code of Civil Procedure Section 860 allows a public agency to file a California Superior Court lawsuit to determine the validity of a matter. Opponents who said the tax measures required a two-thirds vote rather than a majority vote prompted the procedural move to validate the initiatives, Supervisor Norman Yee, who wrote commercial lease tax measure Proposition C, said during a July 17 Budget & Finance subcommittee hearing.
