Ohio, Treasury Spar Over Effect of Arizona Ruling on ARPA Case

The state of Ohio and the US Treasury Department are dueling in a federal appeals court over how a recent ruling reviving Arizona’s challenge to federal restrictions on nearly $200 billion in Covid-19 aid affects their appeals in a related case.

The US Court of Appeals for the Ninth Circuit ruled May 19 that Arizona has standing to challenge the American Rescue Plan Act’s restrictions because there’s a realistic danger the federal government will enforce the act, and the act potentially infringes on state sovereignty.
