Facebook Tries to Bar UK, Australia Tax Audits as Trial Evidence

Facebook is trying to stop the IRS from introducing evidence on the company’s prior tax settlements with Australia and the U.K. to shape its argument in a likely weeks-long trial.

The IRS wants to bring in documents and statements related to the social network’s settlements with the Australian Taxation Office for its tax returns from 2009 to 2013 and with Her Majesty’s Revenue and Customs for its 2010 U.K. tax returns. The agency argues that Facebook’s position before the Australian government was the “opposite of and inconsistent with” the position it is taking before the U.S. Tax Court.
