Worker Safety, Privacy Clash as Temperature Checks Spread

Workplace temperature screenings are becoming the norm after getting a go-ahead from the EEOC, which enforces a federal disability law limiting when businesses can require workers to get a medical exam. But employers trying to avoid penalties under privacy and disability laws will have to pay attention to how screenings are administered.

Protect Workers: Retailers such as Amazon.com, Walmart Inc., and Target Corp., along with grocery chains, health-care providers, and other businesses, are already checking workers’ temperatures. Problems could arise if companies gather and store worker information that could reveal health issues outside of Covid-19, attorneys and academics say.
