White House Reviews DOL Religious Shield Rule for Bias Claims

The White House’s regulatory office is reviewing a U.S. Labor Department final rule on shields that religious federal contractors can raise to avoid workplace discrimination liability.

The rule, as proposed by the DOL’s Office of Federal Contract Compliance Programs, would codify existing exemptions available for religious federal contractors, which allow them to make employment decisions based on their religious beliefs without penalty. The proposed rule also would apply to “closely held” federal contractors—where a small number of individuals own the majority of stock—if those individuals are making employment decisions based on their faith.
