WHD Inspectors Pressure Employers to Settle
Cases Too Quickly, Witness Tells House Panel

The Labor Department’s Wage and Hour Division is increasingly using heavy-handed methods to pressure employers into quickly accepting its settlement offers, often without the benefit of legal counsel, an attorney representing the U.S. Chamber of Commerce told a House Education and the Workforce subcommittee June 10.

Many enforcement techniques used by the WHD are “beyond the pale and in some cases abusive,” Leonard Court, a senior partner at Crowe & Dunlevy in Oklahoma City, testified before the Subcommittee on Workforce Protections. “The focus is shifted from doing the investigation right to seeing how much money they can collect,” he said. ...
