West Virginia’s Public Worker Union Dues Deduction Ban Back On

The West Virginia AFL-CIO and various unions were wrongly granted a preliminary injunction barring enforcement of a state law prohibiting state employers from continuing to deduct union dues and employee-association membership fees from public workers’ wages, the state’s top court ruled 3-2.

A lower court conducted a “less than careful consideration” when it found the unions showed a likelihood of success on the merits of their constitutional challenges to the West Virginia Paycheck Act, the Supreme Court of Appeals of West Virginia said Monday.
