Wendt Corp. Petition to Decertify Union ‘Tainted,’ NLRB Rules

A New York recycling equipment manufacturer’s petition to decertify its employee union failed after a split National Labor Relations Board found that the company’s year-long course of “serious and pervasive” unlawful conduct tainted the process.

In a prior ruling in 2020, the board found Wendt Corp. temporarily laid off a third of its bargaining unit in 2017, curtailed wage increases, and deliberately underpaid a pro-union leader. Those violations were severe and recent enough that they were undeniably linked, the board ruled.
