Walmart Can’t Get Court to Set Down Suitable Seating Class Action

Walmart must continue to defend against a class action filed by a group of cashiers in California after an unsuccessful effort to break up the lawsuit with a potential for more than 22,000 members.

The world’s largest retailer lists 306 total retail units in California and 89,881 associates. The class was certified in 2012 based on an estimate that there were some 22,572 eligible cashiers. Of the over 5,000 court filings against Walmart in the last five years, 14.6 percent have been employment-based claims.
