Vantage Energy Services Inc. failed to convince the Fifth Circuit Friday that an EEOC bias-related enforcement action on behalf of an injured oil rig worker was invalid because its formal charge was filed too late.
The district court erred when it ruled the EEOC failed to exhaust administrative remedies before filing the action, the per curiam opinion said.
