UPS Beats Fired Delivery Driver’s Age, Disability Bias Suit

A former United Parcel Service Inc. delivery driver lost his discrimination suit because he failed to show the company’s stated reason for firing him, lying about a botched delivery, was a pretext for age bias, a federal court in Florida said.

Joel Rainey delivered a package to Dialysis Clinic Inc. He knew that he had two other packages for the company in his vehicle that day, but couldn’t find them. He “prerecorded” delivery of the missing packages by leaving the electronic delivery record open so he could add the other two boxes later.
