Union Dues Deductions Continue Post-Contract, NLRB Rules (1)

Employers must continue deducting union dues from workers’ paychecks as agreed in their labor contracts even after those deals expire, a divided National Labor Relations Board ruled.

The NLRB’s 3-2 ruling issued Monday reinstates its Obama-era requirement keeping dues-checkoff arrangements in force after a collective bargaining agreement ends. The board’s two Republican members dissented.

The NLRB had overturned that rule in 2019—when the board was under GOP control—but reversed course after a federal appeals court instructed it to provide further explanation for its handling of dues checkoffs.
