Uber Says Forced Reclassification of Drivers Isn’t Warranted

A California-based Uber driver can’t establish that he suffers irreparable harm from alleged misclassification, given that he recently accepted payment as a remedy for nearly-identical claims, Uber told the Northern District of California.

Thomas Colopy asked the U.S. District Court for the Northern District of California Oct. 8 to issue a preliminary injunction ordering Uber to reclassify him and all other Uber drivers in California as employees. Uber responded Oct. 29, saying that Colopy doesn’t satisfy the stringent requirements to obtain the “drastic” remedy.
