The Trump administration is urging an Oregon federal judge to throw out a challenge to its ban on immigrants without health insurance, saying he doesn’t have the power to issue injunctions “purporting to supervise the president’s performance of his duties.”
“All of plaintiffs’ claims ultimately challenge the president’s authority and directives,” the Justice Department says in court papers filed May 29. “This court lacks jurisdiction to grant injunctive relief against the president.”
The proposed ban, announced by President Trump in October, would suspend “the entry of immigrants who will financially burden the United States healthcare system.”
