Total Safety’s Non-Solicitation Clause Void Under Louisiana Law

Petrochemical industrial safety services provider Total Safety U.S. can’t pursue a breach of contract claim against a former employee because the non-solicitation provision in his contract is void under Louisiana law, the Eastern District of Louisiana ruled Nov. 6.

Todd Meyer worked as a safety sales specialist who left Total Safety for its competitor, Code Red Safety & Rental. Total Safety sued, arguing that Meyer used its confidential information and trade secrets to solicit customers in violation of a one-year non-solicitation clause in an agreement he’d signed, among other claims.
