Top NLRB Lawyer Pushes for Expansion of Damages Unions Could Pay

The National Labor Relations Board’s top lawyer wants to raise the damages unions could have to pay workers for not fairly representing them as required by federal labor law.

The NLRB general counsel’s office argued that an American Postal Workers Union affiliate should be on the hook for all damages a worker may have suffered after the union failed to process her grievance challenging her termination from the Postal Service. But the NLRB declined to expand the possible damages beyond the increase in damages as a result of the union’s misconduct, according to a Tuesday ruling against the union.
