TIAA Bank Employees Advance Some, But Not All, Wage Claims

A group of loan officers may proceed as a Fair Labor Standards Act collective on claims that TIAA Bank shorted them on regular and overtime wages, but will have to arbitrate certain aspects of the lawsuit, a federal judge in Manhattan ruled.

The plaintiffs presented evidence that those employed as Retail Loan Officers were expected to, and often did, work beyond 40 hours per week, were uniformly classified as outside salespersons exempt from overtime pay, and performed most of their job duties at a fixed location.
