Texas Roadhouse Ponies Up $12M to Settle Age Bias Litigation

Texas Roadhouse has agreed to pay $12 million to settle an at-times contentious EEOC litigation alleging that the restaurant denied server, host and other front-of-house positions to applicants over the age of 40 (EEOC v. Texas Roadhouse, Inc., D. Mass., No. 11-11732, settlement announced 3/31/17).

The settlement, announced March 31, comes after an almost four-week trial in January that resulted in a mistrial. A jury three times couldn’t reach a unanimous decision on whether the national restaurant chain engaged in a pattern or practice of discrimination in violation of the Age Discrimination in Employment Act.
