The dismissal of female detention officers’ discrimination suit over a gender-based scheduling policy was upheld by the Fifth Circuit on Wednesday, but the panel deciding the case urged the en banc court to revisit the precedent that directed that result.
In 2019, the Dallas County Jail implemented a gender-based schedule policy that only allowed male officers to take full weekends off, while female officers were left to choose between two weekdays off, or one weekday and one weekend day off. Previously, the schedule policy was based on seniority.
