Teamsters Want Injunction Lifted in California Trucking Battle

The Teamsters urged the Southern District of California to temporarily lift the injunction blocking enforcement of AB 5 against California truckers until the Ninth Circuit decides the key federal preemption issue underpinning the court’s order.

California federal district courts have reached different conclusions about whether the Federal Aviation Administration Authorization Act preempts California’s new worker classification law, the International Brotherhood of Teamsters said Tuesday. The union applied for emergency stay of the injunction issued Jan. 16 by Judge Roger Benitez, who concluded that the FAAAA likely preempts AB 5 as it applies to the California Trucking Association’s members.
