OSHA Infectious Disease Rule Lawsuit on Hold After Biden Order

A lawsuit seeking to force the Occupational Safety and Health Administration to enact a rule protecting workers from airborne diseases may be resolved without the help of the Ninth Circuit, now that President Joe Biden has issued a related executive order and his administration is shifting the agency’s priorities.

Unions including the American Federation of Teachers and the American Federation of State, County, and Municipal Employees asked the Ninth Circuit to require OSHA to accelerate issuance of the rule started by the Obama administration in the aftermath of H1N1 virus concerns.
