Suit Over Lincoln Life’s Lengthy Disability Leave Hits Roadblock

A California office worker who says she lost her job because Lincoln Life Assurance Co. of Boston improperly placed her on extended disability leave struck out in federal court, when a judge ruled her negligence claims are preempted by ERISA.

The worker’s claims of professional negligence under state tort law involve the relationship between a benefit plan fiduciary and a plan member, because they challenge a decision made in a fiduciary capacity, Judge Laurel Beeler of the US District Court for the Northern District of California said Thursday.
