Social Services Worker’s California Whistleblower Claim Revived

San Bernardino County must face a social services worker’s claim he was fired in retaliation for reporting problems with a database tracking child abuse, despite a state administrative ruling upholding his discharge, the Ninth Circuit ruled Dec. 30.

Eric Bahra was correct that whistle-blower claims under California Labor Code § 1102.5 are exempt from the state’s usual rule that decisions by administrative agencies generally are given the same preclusive effect as court rulings provided they have a sufficiently “judicial character,” the court said.
