Revised Immigration Agency Policy May Affect Work Authorizations

A new update to the field manual used by federal immigration officers when adjudicating visa petitions could insert greater uncertainty into whether applicants are granted work authorization, immigration attorneys fear.

U.S. Citizenship and Immigration Services issued a policy update Wednesday that reminds officers to “refer to existing guidance, now consolidated in the USCIS Policy Manual, on the exercise of discretion in adjudications.” The agency said the update was part of President Donald Trump’s June 22 immigration proclamation to suspend certain visa categories, which addressed the Department of Homeland Security’s administration of employment authorization benefits.
