Restaurant Groups Mulling Appeal of Wage Rule Injunction Denial

Restaurant groups are considering an appeal of a Texas judge’s order denying their request to block a Biden administration rule requiring them to pay some tipped restaurant workers a full $7.25 minimum wage, as their lawsuit to overturn the measure proceeds.

“A direct appeal now is definitely in the cards. Looking at all options,” Angelo Amador, who is representing the Restaurant Law Center and the Texas Restaurant Association in the lawsuit, said in an emailed statement. “While this temporary setback is disappointing, we are still in the early stages of this litigation.”
