Provider Suing Aetna Lacks CARES Act Claim Over Covid Test Costs

A medical provider suing Aetna Health of California Inc. for more than $4,900 in Covid-19 testing costs must try again after a federal judge ruled that the CARES Act doesn’t authorize private lawsuits to enforce its testing reimbursement requirement.

The ruling, issued Thursday in the US District Court for the Northern District of California, is one of the first times a federal court has considered whether the Coronavirus Aid, Relief and Economic Security Act authorizes private parties to file lawsuits claiming violations of the statute.
