Postmates Catches Break on Delivery of Labor Board Charge

A former employee’s failure to timely notify delivery service Postmates Inc. of an unfair labor practice charge precluded the NLRB from pursuing the case, the labor board’s Division of Advice concluded in a memorandum released March 13.

The memorandum highlights the importance of serving an unfair labor practice charge within the National Labor Relations Act’s six-month statute of limitations. Service is the formal delivery of a charge to an employer or union alleged to have violated federal labor law.
