Parkland Hospital Defeats Race Harassment, Retaliation Suit

Parkland Health and Hospital System in Dallas County, Texas, doesn’t have to face trial on a black former operating-room aide’s claims that he was subjected to a hostile work environment and fired in retaliation for complaining about his treatment, the Fifth Circuit ruled Thursday.

Robert Collier’s retaliation claims under Title VII of the 1964 Civil Rights Act and Texas law failed because he didn’t rebut the Dallas County Hospital District’s explanation that he was terminated for insubordination, the appeals court said in an unpublished ruling.
