NYU Seeks Help from Supreme Court in Retirement Plan Fee Lawsuit

New York University wants litigation over its retirement plans to get a second look after the U.S. Supreme Court rules on a similar case against Northwestern University, the school said in a new petition.

NYU says the the case against it presents the same legal question that the justices agreed to hear in Hughes v. Northwestern University: whether a retirement plan participant has a viable claim for fiduciary imprudence under the Employee Retirement Income Security Act based on allegations that the plan offered retail share class mutual funds when identical institutional share classes were available at lower cost.
