No Life Insurance Owed After Heart Attack First Month on Job

United of Omaha Life Insurance Co. properly denied $115,000 in life insurance benefits to the widow of a man who had a heart attack less than one month after starting a new job and enrolling in coverage, a federal judge in the Eastern District of Kentucky ruled.

Rachel Lee argued that her husband satisfied the criteria for coverage, because his death on Oct. 26, 2019, occurred after the 30-day eligibility waiting period for his policy. Judge Gregory F. Van Tatenhove disagreed in an order docketed Wednesday, saying that Lee’s husband wasn’t “actively working” for the full 30-day period as required...
