NLRB Wrongly Approved Theater Union With No Workers: 1st Cir.

The National Labor Relations Board misapplied the law when it wrongly certified a union of musicians at Boston’s Wang Theatre that consisted of no employees, the First Circuit ruled.

The bargaining unit approved by the NLRB was empty because the Wang Theatre Inc. had not hired musicians since 2014, had no plans to, and had not been requested to do so for any future production, the court said in its ruling Monday. The board failed to sufficiently explain why it broke from its default standard requiring at least two workers in a bargaining unit, the court said.
