NLRB Voids Vote-by-Mail Order, Sends Case Back for Second Look

A National Labor Relations Board official in Chicago must reconsider whether health-care workers at Rush University Medical Center should vote in a union election by mail because of the coronavirus pandemic, the board ruled.

The acting regional director misapplied the legal test for deciding how workers should cast ballots during the pandemic, the NLRB said Tuesday. The official wrongly held that the additional risk posed by emerging Covid-19 variants—more contagious and lethal mutant strains of the virus—was enough to trigger a mail-in election rather than having voting take place in the Chicago hospital, the board said.
