Facebook Rant by Trader Joe’s Worker Not Protected Speech: NLRB

A Trader Joe’s employee’s social media rant directed at customers of the supermarket chain wasn’t protected speech under federal labor law, the National Labor Relations Board advice division said.

In a memo made public Thursday, NLRB attorneys said Trader Joe’s management had every right to fire the worker for disparaging customers’ shopping behavior during the Covid-19 pandemic in Facebook and Instagram posts last year. While the worker’s complaints related to workplace safety, the attorneys said, they weren’t protected because they disparaged the employer’s service without directly appealing for support in a labor cause.
