NFL Says Players’ Painkiller Claims Preempted By Labor Law

Federal labor law preempts former NFL players’ only remaining cause of action in long running litigation alleging injured players were given opioids and other pain killers to remain on the field, the league told the Northern District of California.

The suit, brought by NFL Hall of Famer Richard Dent and other retired players, should be dismissed because the remaining allegation that the league breached a voluntarily undertaken duty to intervene in the clubs’ administration of pain medications is preempted by the Labor Management Relations Act, the NFL said.
