New York Life Hit With Class Job Bias Suit Over Criminal Checks

New York Life Insurance Co.'s worker criminal background checks “flout” New York state and city laws by seeking and using information relating to crimes for which job seekers weren’t convicted, a practice that has a disparate impact on Black applicants, a class suit in Manhattan federal court charges.

The New York State Human Rights Law expressly prohibits employers from asking job applicants about arrests that were terminated in their favor, requiring applicants to answer questions about such arrests, and taking an adverse action against an applicant based on such arrests, Aliea Hughes-Phillips says in the complaint.
