Minister Exception to Job Bias Laws Percolating at High Court (1)

An elementary teacher told the U.S. Supreme Court that she isn’t the type of religious employee that would make a Catholic school in Southern California immune to her job discrimination claims.

Agnes Morrissey-Berru filed a brief Oct. 28 asking the justices to reject Our Lady of Guadalupe School’s request to consider whether she qualified as a “ministerial” employee based just on her religious job duties, which would bar her age discrimination and wrongful termination lawsuit. The U.S. Court of Appeals for the Ninth Circuit ruled that her claims weren’t blocked by the ministerial exception to employment laws.
